How Does Divorce Work in South Carolina?

Different states throughout the United States have varying divorce laws and divorce proceedings. Some states, like South Carolina, require specific grounds for divorce.

There are five grounds for divorce in South Carolina, which include:

  • Physical cruelty
  • Adultery
  • Habitual drunkenness
  • Abandonment
  • No fault

A no fault divorce requires the parties to live separate and apart for at least one year. Because of this requirement, many divorce actions first involve an action for separate support and maintenance. This action addresses issues like child support, child custody, and visitation during this one year period.

To begin a divorce action, one party must file the initial Summons and Complaint, which states the grounds on which the divorce is being sought. This document will also make a request as to the division of marital property, alimony, and issues related to any minor children born of the marriage (child custody, visitation and child support).

Once the Summons and Complaint is filed, the opposing party must be served and has thirty days to respond.

Why Do I Need a Divorce Lawyer?

You may believe that your divorce situation does not require the services of an attorney. However, regardless of the grounds for the divorce, whether you are the plaintiff or defendant, or how well you and your spouse are currently getting along, it is not easy or advisable to navigate the process of divorce alone. Even in an uncontested divorce, there are still issues best resolved with the assistance of an attorney.

In reality, there are no winners in a divorce case, but neither party has to be considered a loser or endure the process without representation. Our attorneys are here toguide you through the family court system and make this process as smooth as possible.
